Father's rights

Young man and woman have 3 year relationship.

Marriage is discussed often leading young man to believe marriage is inevitable. Couple gets pregnant and keeps baby. Mother refuses to marry father. Couple lives together. Father was present at birth, totally supports financialy and loves baby and mother; after 5 months mother still refuses to marry father so father moves out. Mother continues to live in the apartment that father pays for and accepts money for her and baby's needs. Mother says father has no legal rights to baby. Is she correct??

Yes, in Georgia this is true. In Georgia, the father of a child born out of wedlock has no rights to the child until he does what is called Legitimation. This is a process that can only be done by the father. He has to file an action in court to legitimate the child. Once the child has been legitimated, his rights are equal to those of the mother. Until then, the mother can deny him visitation to the minor child. The procedure is fairly simple and the father should contact Families First's Access and Visitation Division for help in this matter.
