Hearing

If someone living out of the state of Georgia is not officially/legally served about a hearing until 1 week before the scheduled hearing and is only informed by phone 1 week before the hearing; does she/he needs to appear at the hearing? How to cancel such a hearing in which one of the parts was NOT informed on a properly and timely manner and was not even served...

Re: Hearing

Service by telephone is not proper or valid service under the rules of civil proceedure. Therefore, you are not required to appear. Eventually they will do it right and you will have to appear.
