Legal Question in Family Law in Georgia

my husband and i just found out that he is still legally married to another person. He thought the divorce had been resolved we later found out that it wasnt due to his ex not taking the court ordered parenting class. She states that she will not take the class and give him the satisfaction of being with someone else (me). If our marriage is voided how long would we have to wait to remarry after the divorce is finalized.

After the divorce is finalized, you can get married right away.

Was the original matter a contested or uncontested divorce?

If this was a contested divorce has your husband tried to file a motion to compel or for sanctions?

If this was an uncontested divorce, he may want to file a contested divorce.

It might not be as easy. Your husband has committed a crime punishable by prison time. "Just found out" he was, and is, still married is not an excuse when a person should obviously know the prior divorce was not final. Ignoring the status of a court proceeding is not an excuse. Your husband should see a lawyer now. This is not an issue for a website, especially he is in the position he is in now because he did not have a lawyer properly handling things.

Your big problem (and his) is bigamy. See a lawyer right away. If he had done that at the time there would be no problem now. A lawyer can probably help finalize the divorce.

You can marry as soon as the divorce is final.
