names changes

My children were not able to have their father's name on their birth certificate because when I had my first child I was still legally married to someone else. There's no one listed as a father on the birth certificate. My son doesn't have no one listed on the birth certificate because the hospital said since he was conceived before my divorce was final his dad couldn't sign the birth certificate.They have the same father. I had to give them my married last name. We were working on getting their names changed and getting then legitimized but there father is now in prison for 10 years. I was wondering can he start the paperwork from prison to legitimize them? Or how can give them my maiden name.I'm also considered to be low income. What can I do to get their names changed for a low price or can I get the forms and submit them myself to the court system?
