Logo

When you pay someone to create a logo for your business, who legally owns the logo? The company that created the logo or the company that paid for the logo?

In many cases the logo creator may get a Copyright of the work. Were you involved in the actual creation of the logo except for the payment? Did you have a work agreement in writing?

Generally, the entity that pays to have a third party create a logo owns the trade or service mark. However, there may a contract that reads otherwise.

The payor may own the mark but its copyright would be owned by the designer/creator of the logo unless there is a written agreement stating that the logo was a work-for-hire. You would be well advised to get that agreement and should confer with an attorney to do so.
