Legal Question in Employment Law in Georgia

Breach Of Employment Contract/ Failure To Notice

One of my friend got sued from previous consulting company for breach of contract. The contract was for 18 months and she left the company after 16 months. Now 5 months later she recieved a summon from the superior court asking her to reply with an answer within 30 days otherwise she'll have to pay approximately 25,000 and all the fee for plaintiff's lawyer. The contract was for 10,000 if she leaves before 18 months without giving 2 weeks notice, which she didn't do and left the company without notice.

1. She's now in Florida. Is Georgia's jurisdiction applicable to her.(Contract was signed in Georgia).

2. How serious is it, and what she needs to do to get over with this.

She's left with 1 weeks time ie. till 28th DEC.

Re: Breach Of Employment Contract/ Failure To Notice

This is a very simple situation. If she does not hire a local lawyer, by local I mean in the state where the lawsuit was filed, to file a timely response to this lawsuit, then the court will declare the loser of the lawsuit and she will have to pay.

Re: Breach Of Employment Contract/ Failure To Notice

Your friend absolutely needs to reply to the lawsuit. Even though she is in Florida, there is a very good chance that the Georgia courts will have jurisdiction over her because the contract was executed and, presumably, performed in Georgia.
