Are homeowners associations legal entities in the state of Georgia and if so what are the requirements for formation and sustainability?

Condos have their own set of rules as set out in the Code. However, in single-family detached dwelling subdivisions, there are no requirements that the association be incorporated. However, as a practical matter, in "swim-and-tennis" subdivisions, the developer usually incorporates the association so that at the appropriate time there is a legal entity to whom he can transfer title to the land on which the amenities are located.
