Legal Question in Wills and Trusts in Georgia

attorney fees

My cousins and I are plaintiffs in a lawsuit. Because of summary judgement it didnt make it to a trial. our cousin( which is the defendant) cousin has filed a counter claim that says we have to pay his lawyer fees. Do we have to pay--since we didnt get to have our say in court? It is being appealed. Thank you
