A few months ago I asked a question regarding my brother who is adminstrator of my parents estate my 5 brothers, my nephew, and myself all signed documents to allow him to serve as administrator. IN July of 2005 he borrowed 60,000.00 on the home that I live in which belonged to my deceased parents the loan was made to repairs to the house however only 20,000.00 went to toward home repairs. My brother took the rest and started a business. I was informed today that he is now 4 months behind in the loan payments and it seems as if we stand to loose our family home which is were my children & I live now. I was advised in my original question to consult a lawyer because use of estate money for personal use was illegal; however my brothers and I decided not to presue the matter in order not to cause any discord in the family. Is there any thing that can legally be done to save our family home. The actual amount he is behind is 2,800.00 we have not heard anything officially from the loan company and also if we get the money to pay what is owed is there a way that we can go directly to the loan company without giving the payment to our brother. Also is there a way to get the loan in another heir's name.
