Legal Question in Wills and Trusts in Georgia

My sister is the executor of my mothers will. My mother died in Sept 2010 in Georgia. We gave her car back to the creditors, now they are trying to get the estate to pay what was the balance after auctioning. My mother's life insurance is not a lot of money. Can we fight this? My brother said that the estate closed 30 days after putting this in the newspaper. Any advise?

Assuming the lender did everything correctly, it is a valid debt against the estate just like any other debt. As far as estate issues, your sister has a duty to handle the affairs of the estate correctly. If she does not know what to do, she should retain a lawyer now, before more problems arise later.

She should have seen a lawyer before allowing the car to be repossessed, which was likely NOT the best option. She should get a lawyer now before she screws things up more.
