Stepmother's rights on estate

My father passed away 2 days before he was to sign his will at the attorneys office, or at least that is what my stepmother told us, so apparently he has no signed will. If this is true what legal rights do we have on the estate and if this information is a lie how would we find out if he really did have a will?

If he died without a will the widow shares equally with his children, except that her share will be at least one-third. I would check with the attorney about the existence of the will. Other than that, I don't know how you would find a will or any other piece of paper.
