Legal Question in Immigration Law in Idaho

Green card cancellation

I was married to a US citizen for 6 years, I left him for 8 months now. he's planning to cancel my green card, can he do that? I got my GC year 2005. He is filing for a divorce. What should I do to retain my greencard?

Re: Green card cancellation

There are actually two "green" cards which are actually blue. The first card is issued temporarily followed by a two year period after which a permanent green card is issued. If you've received your permanent green card your only requirement is continue to maintain your permanent residence in the U.S. I don't believe there's anything he can do to revoke your card. The law presumes if the marriage ends during the two year period prior to obtaining the permanent card the marriage was confected to obtain a visa, although it is a presumption. After the two year period there is no presumption

suggest you spend the money to consult with an Immigration lawyer in your area
