Legal Question in Credit and Debt Law in Illinois

Name on car title

I cosigned and am paying for an automoble for my son. Both our names are on the title. He was paying the insurance. He is having mental problems and soon will not be able to pay the insurance but also won't work and is charging eveything on a credit card. I am afraid he will not be able to pay the credit card and they will take the car. How can I get the car company (I am still paying for it) to get his name off of it if he won't sign it over.

Sorry to hear about your situation. You are facing an uphill battle here.

What are you trying to accomplish? You want to be able to pay the car bill? What do you want to do with his credit card - are you on that as well?

If your son is experiencing difficulty, how severe is it? If it is to the point where he is becoming unable to manage his affairs, you could petition the court to have a conservator (eg, you)put in place. A conservator becomes necessary when an individual is deemed unable to manage their financial affairs.
