Legal Question in Credit and Debt Law in Illinois

A collection agency is claiming that I took out a payday loan but what they are telling me does not ad up. They refuse to send me proof and are rude. I am not employed and can not pay them. I do not think it is legit and would like to know what I can do to avoid the court summons they claim they have.

Could be a scam but you do not say whether you took out a loan or not! Assuming you did not take out a loan, there could be some identity theft involved. But if they refuse to send you any proof, and they claim to be a collection agency, the next time they call you can tell them you will report them to the Illinois Department of Financial Institutions and Professional Regulation, which licenses collection agencies and could cost them their license if they are legit.
