Legal Question in Credit and Debt Law in Illinois

credit card judgement

My husband and I had a credit card together and he left. I myself am on Social Security Disability. The credit card company is threatening to get a judgement against me. Can they garnish my SSD check or come in my building and take my stuff out of my apartment. I make just over $500 a month and live in an elderly disabled building.

Re: credit card judgement

If the card is in your name, they can attempt to collect the judgment. Only a court can decide whether you are in a position to make payments out of your social security. They cannot take things out of your apartment unless the card was secured with physical property which would be unusual. More info would be needed to make a full opinion.
