Legal Question in Credit and Debt Law in Illinois

judgment

I was sued by montgomery wards. they are now out of business. but there is a judgment against me that I could not get removed because they are out of business. It seems to me that a public recorder should have to automatically remove a jugment if someone doesn't have the oppurtunity to get it satisfied with the creditor. Is this correct?

A judgment is only removed if it is satisfied or set aside by the Court based on a legal reason. However, judgments have a certain time period for execution after which if they are not renewed they cannot be executed on. If the judgment is in Mississippi, the statute of limitations for execution on the judgment is seven years. However, the judgment will still be on the clerk's judgment rolls, it just cannot be executed on. You should be able to have it removed from your credit report, however. You should be able to have it removed from your credit report, although not from the clerk's records as a judgment.
