Legal Question in Credit and Debt Law in Illinois

I received several treatments and fell behind on all bills. I then sent 4 checks totalling over $300 on a bill that was $471. The following month I received a summons for court. I contacted the atty and was told they had no record of payments. They contacted the creditor and they said they applied it to other accounts which hadn't even taken place yet. Why wouldn't they apply them to the original amount. Is this something that I can fight in court?

Absolutely. Show up with copies of your cancelled checks. You might do a little reading on the internet before you go regarding "conversion." I bet that will get their attention. Good luck!
