Legal Question in Family Law in Illinois

Alienation of affection as cause of divorce

Can a woman sue for divorce based on alienation of affection, and if so can an employer be named as the correspondent in the divorce. His company works him 12 hour days, 7days a week. He is entitled to 3 wks vacation but isn't allowed to take more than one and isn't compensated for the other 2, it is just time lost. I can no longer sleep with my husband because his company calls him at all hours of the night. The marriage is shot. He can't quit his job, he is 52 and would have a very difficult problem finding another job. This situation has affected my emotions to the point I can barely function. I need to know my options.

Re: Alienation of affection as cause of divorce

Well, that's a cause of action that I've never heard of before, but I like your creative thinking. I suppose it's possible, but my gut reaction is that it is not a likely "winner."

The job situation sounds absolutely horrible for everyone -- like slave labor.

Your husband NEEDS to put his foot down -- or he's going to die early from stress and lose his marriage.

Yes, it's risky for him to do that, but what good is it to keep his job if he drops dead from a heart attack, alone?

If you are miserable, he needs to be told that. Then the ball is in his court -- he can work to remedy the problem or he can let you leave. At that point, the choice is his.

When you married him, I'm sure this isn't want you wanted. This is his problem to fix -- just make sure he knows it's a problem in your eyes and that your marriage is in mortal danger.

Let me know if this helped, OK?
