My husband and I had a child 10 years prior to our marriage. My husband never signed a birth certificate and has agreed to the divorce. I am not asking for support for the child, and we have agreed that I will retain sole custody as it was prior to our marriage. Do we need to include our son in the divorce? as he was not born during the marriage.

Hello. I suggests that you mention

your son in the divorce. It is also

a good idea to have dad pay child support. You can never tell what you may need. The judge will want this in the best interest of your child.
