/Can you divorce a spouse in a nursing home?

To a short question... a short answer: YES. However, if the spouse is in a nursing home there may be a competency issue. After the initial pleadings, if competency is an issue, the Court may require that a guardian ad litem be appointed to represent the interests of the incompetent spouse to make sure that he or she receives a fair share of the assets (and liabilities).

In a situation like this I strongly advise that you seek the help of an attorney.
