Legal Question in Family Law in Illinois

restraining orders in marrage

we are seperated but due to financial and health issues we both still reside in the family home. He has threatened my safety to our daughter. How can I get him to move out when the home is in both our names? I am the one making all the morgage payments as he is frequenyly unemployed.

Re: restraining orders in marrage

Hello. I am sure that you are under a lot of stress. In my opinion you should file for an order of protection based upon these threats. That would get him out of the house in your best interest. I suggests that you have representation when you decide to do this. Will be happy to discuss this further and in more detail.
