Legal Question in Family Law in Illinois

Terminating Parental Rights

I am the custodial parent of my son. His birth father (we were not married when my son was born) has nothing to do with him and lives in IL. What steps do I need to take to have his parental rights terminated so that my husband can adopt my son? What steps should the birth father take to have his rights voluntarily terminated?

Re: Terminating Parental Rights

Your husband should begin the process of adopting your child. During this process, the biological father's rights will be terminated if the court is satisfied that it is best for your husband to adopt, or the biological father consents to the adoption.

Your husband needs to know that if he adopts your child, and the two of you split sometime down the road, he will be responsible for child support for the adopted child.
