dog injured by another dog not leashed

iv been going to small claims court for over 6months. the last court the defantents lawyer got a court order for a deposition on sept 30, 2006 to be done by jan 24th 2007 he made a date with my vet for feb.5 2007 i cant be there so we cancelled now he sent a subpoena for that date. my ? is does a court order override a suponea for a depo that shoud of been done by jan 24th2007? we were just contacted on jan 15th 2007 for the 1st time a week before the court ordered was to be over. please help thankyou in advance

There is usually flexibility in discovery schedules. Since they did contact you to set this deposition before the due date, a judge would probably side with them. I suggest you attempt to schedule it for a day that meets everyones needs.
