Legal Question in Intellectual Property in Illinois

Copyright Infringment

I have a copyright since 1997 for my creation the Pocket Living Will. In 1998 I used that name for my domain name for my website. As of April 2008, someone has taken over my domain name which is copyright protected. Can I ask that he change his domain name to something else since it looks like he is selling my product?

Re: Copyright Infringment

The domain name is protected by trademark. Have filed a Federal registration for your domain name? If not, you still have common law copyright protection. You need to speak to an attorney in your jurisdiction about assisting you with this matter.

Good luck!
