Legal Question in Landlord & Tenant Law in Illinois

I have been asked by my landlord's wife to vacate my apartment in 2 weeks due to I've called the police on the neighbors for being noisy after curfew (9:30 in this neighborhood) too many tmes to the point they don't update their lease. They said it's because they have to get new tenants and it's costing them money. I do owe them backrent but they said "that's important but we're evicting because of loosing tenants". I asked if they could fashion a letter of eviction so I could get a hardship loan from my 401K and they said that they couldn't. If I wait to be served, how long do I have in the county of Du Page in Illinois.

You are entitled to proper notice and to defend an eviction lawsuit. If they serve you with proper notice, and you don't move, and they file the eviction case, that could take a month to get to court, and you should be granted a 30-day stay to move, and if you don't then the landlord has to call the sheriff out (with a moving company) and when that happens all depends on how backed up the sheriff and moving company may be. You can check with the sheriff by calling, they may tell you. And then again it's impossible to say for sure and could be sooner, and ultimately you would be liable for the sheriff's and moving company fees too . . . but in the end you will wind up moving because the landlord eventually won't renew you. Your best option may be to negotiate time to move out without a lawsuit where they release you from any more rent. An attorney can help with this. Really.
