Legal Question in Landlord & Tenant Law in Illinois

my son passed away. the landlord is withholding the security deposit, pending the apt. is rented. i've removed all belongings, cleaned the whole apt. top to bottom. they are saying he broke the lease, and are intitled to the security deposit because. is this legal?

This is very sad; sorry to hear about your son. Unfortunately, just because your son passed away doesn't mean the lease came to an end, so they could be right if rent went unpaid and nobody did anything about it. Also unfortunately, it could cost more to sue the landlord than it might be worth. If you want to make sure you should talk to an attorney and if you don't know one you can check w/ the local bar association that may have a lawyer referral service or legal aid if it is truly a burden.
