Legal Question in Landlord & Tenant Law in Illinois

Can a student be sued for unpaid rent?

My son signed a lease for an apartment at school in February for the term of August 2006 - July 2007. He has since found out he will not be able to return to school. The lease states he or the landlord can try to find someone to sublet, otherwise they are responsible for the rent and if not paid, the costs associated with a law suit.

As a student, he has no assets and a very small income. Can he be sued? We, as parents, did not sign the lease.

Re: Can a student be sued for unpaid rent?

Although he is still a student with small assets, he can still be sued and held liable under the lease for the amount lost by the landlord. The contract lease will probably also have a provision for interest and attorney fees. Although there are no assets, the landlord may petition the court for wage garnishment, assuming landlord gets a judgment.
