Legal Question in Personal Injury in Illinois

Accident question

I was involved in an accident where the other driver pulled out within 10 feet of me onto a 2 lane road that has a 45mph speed limit. I have not made a claim with the other insurance but am now having back and neck pain. The other driver stated that they were at fault at the time to the state trooper who stopped but are now changing their story saying I tried to pass them. They have made a claim with my insurance. Do I have a right to make the claim with their insurance or should I let my insurance fight it out?

If you are waiting for the insurance company (either of them) to fairly compensate you for the injuries you have sustained, you may have to wait a LOOOONNG time...

Of course you can make your own claim. The other driver has no right to make any claim on your insurance if he has been at fault. You have absolutely a right to make a claim on the other driver's insurance for all your medical bills, wage loss, loss of normal life, pain & suffering and any out of pocket expenses you may have incurred. The only thing your insurance will probably take care of is the property damage to your car.

You can make a claim with the other insurance company; but you should know that everything they do is designed to protect their interests,not yours. They may try to take a recorded statement from you, and then use it against you.
