Legal Question in Personal Injury in Illinois

Contract Acceptance

We wrote an offer for a small farm, a family member came by and said they have accepted our offer. They now have accepted someone elses offer, two weeks later? Is verbal acceptance good enough?

Re: Contract Acceptance

Depends on the state in which you live. Some states recognize oral contracts as valid, while others do not. If you live in a state that recognizes oral contracts, then you may have a valid specific performance claim, although you really need to consider if it's worth pursuing (it would be best if handled by an attorney) or if you should just keep trying to find a buyer. If you began to act in reliance on the acceptance, this will bolster your claim, but again, only if your state recognizes the validity of oral contracts.

Hope that helps.
