Legal Question in Personal Injury in Illinois

A contractor hurt himself cutting down a tree in my yard. Now, he is refusing to finish the job and threatened to sue my homeowners insurance. What are my rights? Does he have a case ? He also damaged my gate and fence in the process.

This is one of the reasons why you have homeowners insurance. Contact your agent. The company will do a full investigation and determine whether there is a case. You may have to file a suit against the contractor for your damages.

Mr. Padove is correct. Call in the claim immediately. There are multiple claims here. The personal injury claim by the contractor, the property damage claim he has caused to the property, and finally the failure to complete the job as contracted. Get out your contract. You'll need it. You may also demand to know his workers compensation insurer who is also responsible for this personal injury claim. If he does not have workers comp, you have learned a valuable lesson...always make sure your contractors have insurance.
