My husband filed a PI case with his attorney for an injury that was clearly the fault of the condo association for it blatent misplacing of drainage to a public sidewalk and the ''building code'' was violated. they had no rebuttal.. his lawyer told him it was worth about 90-100 thousand. He told him three years later that because we were in a chapter 13(caused by my husbands inability to work his normal position, and being off for 6 months re surgery's screws inplanted etc) the insurance company of the condo did not have to settle until our chapter 13 was over. we settled at 50, to ''help us out''. His lawyer also told him that the dr. & hospital bills that his ins. from work paid, had to be paid back. although they were never told of the lawsuit one dr.garnished his wages for a 200.bal due a surgery!!! when it came time for my husband to get his settlement, he received a total of 13,000.00. his lawyer said that the other was to cover legal fees and paying the insurance co off. i asked for receipts, he will not reply. i need these to use for deductions for income tax. i cant get any response or receipts or invoices to substantiate the bs.please help me tell me if he can do this or what i need to do.

Addressing your last question, your attorney owes you a duty to communicate with you. You are also entitled to an accounting for money paid from a settlement, to see how it was disbursed. Most complaints filed with the bar allege refusal to communicate. That may be an avenue you should investigate as well.
