Legal Question in Personal Injury in Illinois

I was rear ended. Other drver's fault. I took the car to their apprpoved garage and the estimate was $2300. But it also stated that their may be hidden damage not included in the estimate. A check arrived from the insurance co for $2300 nothing more. I plan on calling the insurance co about the hidden damage. If they don't cover this damage what recourse do I have. If I cash the check does this release the company from further

damages or can I cash the check signing it "under duress" and take them to small claims court.

signing the check under duress is not going to protect you. you need to get ahold of the insurance adjuster and either get the car thoroughly inspected for damage or in writing say that the 2300 is not full settlement. good luck.
