Dear Sirs:

You have a workmen's compensation case which will provide the benefits you seek.

There are remedies which can be obtained depending upon your ability to return to work.

Please call us to discuss.

Re: shoulder injury at work

You would be entitled to "maintenance", which is the difference between what you were making before the accident and what you are now making working only 24 hours.

You do have the right to this payment and if the insurance company is denying you this...I would contact a lawyer immediately.

I have handled many such cases before and would be happy to assist you if needed. I understand that injuries which take you off the job extremely effect your ability to lead a normal life, especially when you have a family and are not getting paid as you should.

You should know you are entitled to a settlement at the end of your case (when you have finished treatment). The insurance company will try to save moeny and may not offer you what you deserve. Again, a reason you may wish to seek legal help - to know what is a good settlement or not.

Feel free to contact me if you should wish to discuss this further. Good luck!

Re: shoulder injury at work

Of course the WC insurance won't tell you this, but you are entitle to the difference between what you make now and what you made before. The insurance must pay the difference. Unfortunately, the insurance adjuster is not your friend and will do everything they can to short change you. You will be doing yourself a disservice if you do not get the help of an attorney.

The adjuster is trained to find out whatever he can so as to deny your claim or reduce its value as much as he can. In fact, some insurance adjusters get a bonus on the amount of money they have been able to save the insurance company--so they have an incentive to minimize your damages or to unfairly treat you.

Know that you are entitled to all your loss wages, all medical bills must be paid and at the end you are entitled to a lump sum settlement which depends on the nature and extent of your injuries, the time you have been off of work, the amount of your wages and the percentage of temporary total disability you have experienced.

I can help you out if you need it. Whatever you decide to do, you should get the help of attorney who knows the law and who knows what the adjusters know but won't tell you.

I hope this helps,
