Association elections

As a member of a non profit lake association our elections were held in November 2006. The current board refused to count the ballots and sealed them, citing that a member had sent out a letter and another ballot to non members, trying to increase membership, and the ''new'' ballot was ''illegal'' the ''old'' board still has the ballots sealed and is still acting on behalf of the association. How can we members demand the ballots be opened and the resuts be made public, and the new board be put in place?

Hello. In my opinion, it will be necessary for you to seek an injunction. This is a court order which would order the board of the lake association to make the balloting

public. This is an equitable remedy and is complicated. You should have an attorney. This can be done, but

it needs to be done right. I have handled this type of a case before and it can be time consuming so an attorney will save you the stress of

having to convince the board to act
