Legal Question in Real Estate Law in Illinois

Racoons in the Attic of a newly purchased home

Do I have any legal recourse towards the people that sold me a house with racoons living in the attic? Shouldn't this have been disclosed at closing or before? If we were notified we would not have bought the house. After talking to my new neighbors I discovered it was pretty much common knowledge that a family of racoons lived in my attic and the former owners were aware of the situation.

Hello. I imagine that is

very annoying. However,it

depends on what your real

estate sales contract says.

If the house was purchased

by you "as is", you probably

have no legal recourse against

the seller. Furthermore,

the seller can argue that

you were allowed to inspect

the premises. Certainly, this

is a sticky problem. It may

be better to concentrate on

getting rid of the problem

rather than filing suit over

the problem and still be

stuck with the problem.
