real estate closing mistake

Whos responsibility is it to inform a buyer that a name cannot be allowed on the title ? Is the closing lawyer or the mortgage companys responsibility ? A family members name was removed off the title of a home we bought. It was a last min. decision by the mortgage co. so we're told. this was never mentioned at closing by anyone at anytime. We found out when it was too late and the one person named took out a loan and made the mort. payment double, costing me the home, as it went into foreclosure. The other persons name was whited out off the title after the closing, and over the whiteout in handwriting , not type, its says ''in fee simple'' no initials by anyone. Is this even legal to use whiteout on a title ?? the attorney I hired to close never showed up, she sent a last min. replacement who rushed the entire process and never mentioned a title change otherwise I would of filed a quit claim deed immediately. Now Im out of a home, and the person on title got away with my money. I want to sue this lawyer for this mistake, I have four witness's who say none of this was ever, ever told to us at closing.
