Bad Loan

I made a loan to a close friend. Only paperwork is on E-Mails. The person I lent the money to has since died. If I can retreive the E-Mails do I have any chance to sue the estate? It is a sizeable amount.

It's certainly worth a try.

You would want to file a "claim" with the court (if there is a probate estate opened). If it is a sizable amount, as a creditor you have the right to open an estate in order to claim your funds.

Once a probate estate has been opened, there is a 6 month claims period during which a claim can be filed. There will be a hearing, and the court will decide whether it is valid, and how much you should receive.

You may have a chance to recover

your funds.

There is a six month claim period.

You should get together copies of those

emails and proofs on payment of the loan.
