Legal Question in Wills and Trusts in Illinois

My father died two years ago and his third wife has not been responsive to any communicastion since then. I am wondering if there is a way I can see his will, or if it is really legal for her to cut my sister and myself out of all of his property and even the right to know what she did with his ashes.

The will has to be filed in the county where he lived. If not you can open up an estate and track things down

If you know that there was a will, it would have to be on file with the County Probate Clerk and you would be able to see it and obtain a copy.

However, many times, when someone remarries, the property (house, bank accounts, etc.) is put into joint tenancy with the new spouse, allowing it to pass directly to the spouse upon death.

You may want to schedule a consultation with an attorney to review the matter after you have searched for the will. It would be well worth the time and cost to determine what rights you have.
