Legal Question in Wills and Trusts in Illinois

Am I legally responsible to pay my deceased husbands credit card? I notified my husbands credit card company that he dies. I they led me to believe I wansn't responible with our first conversations.

Then I recieved a second phone call from their legal depart and they offered me no interest and reduced the balance by 3000.00. I'm curious if they aren't being up front regarding my rights or obligations

Unless you signed the card contract or otherwise agreed to pay the

debt, you are not liable for the debt merely because you are a spouse.

It appears the credit card company is attempting to persuade you to

assume the obligation. Advice: don't pay it only because you believe

you are legally obligated because you are not.

If your husband left an estate, the credit card company has a claim against the estate. Unless your husband left an estate which is going through probate, I would recommend telling the credit card company that your husband left no estate and ask them not to call you anymore.
