Legal Question in Wills and Trusts in Illinois

Wills/Probate

My exhusband died suddenly at the age of 51. He was remarried with one child. We had 2 children together ages 19 & 21. If he did not have a will, but I knew he would want his children to be taken care of (to go to college). Do my children have a right to an inheritance from their father? And if they do, how do I make this happen? Also, if he had life insurance and named his wife as beneficiary, could that be used as liquid assests to give my children, if she didn't want to sell property or a business at this time?

Re: Wills/Probate

Your children are heirs who have a right to inherit. If the current wife is benificiary of a life insurance policy, that's hers and your children have no right to it.
