Legal Question in Workers Comp in Illinois

I had to have double carpal tunnel surgery. The IME approved it until I decided not to use him for the surgery, then he stated it was not work related. I had received the card for drug card for prescriptions and all. Can they do this?

This could be a tricky situation and I do strongly urge you to seek legal representation. If the insurance company is denying your treatment/benefits, ultimately, the question is whether your own doctor (if you have one) has opined that the need for the surgery is work related. If so, any attorney can attempt to seek benefits for you and the Judge woudl have to decide which doctor he/she agrees with. The fact that the IME doctor changed his opinion would likely play against him, but it depends on the reasons. Good luck and feel free to contact me should you need assistance further.
