Legal Question in Appeals and Writs in India

Miscarriage of justice in Supreme Court of India

SBH official has filed false affidavits in A.P. and Delhi High Courts under oath and obtained stays from both in the same matter simultaneously. Both have unnoticed and ignored his misdemeanour. Delhi High Court judge Ms Usha Mehra snubbed the complainant when pointed out. The case was decided in favour of the complainant under duress as per the terms of the fraudster but not even legal expenses what to talk about court fee were compensated. When a SLP(C)194/07 was filed in Apex Court as a Petitioner in person to take action against the offender for misleading the High Courts quoting the similar example of infamous Zahira Sheik of the Best Bakery Carnage of Vadodara who was convicted for perjury, the Supreme Court without going into the details of the case has acted like a Kangaroo court and dismissed the case instead of taking action against the wrongdoer for taking the High Courts of the land for a ride. I have lost faith and confidence in Indian judiciary as it is for rich and famous people only. Whether any social organisation can highlight this case for pointing out the high handedness of Supreme Court and for restoration of justice? I have retired from a most corrupt Govt. of India Undertaking without pension.

we understand your feelings but we cannot give any opinion unti we see the documents and understand what had really been dealt in court - what had actually presented and the manner of presentation! following churchill (parlimentarily speaking) " half the people in the country are not corrupt!" can we say so!

In my opinion, perjury is a crime and you should have filed a criminal complaint.

Hi,

I do not know your background and personal credentials but I am sorry to point out that language used by you towards Apex Court of the land is objectionable.

Further you have referred to SLP (C) No.194/2007 and this is totally false information given by you inasmuch as this matter related to land acquisition and was between Suneeta Khandelwal and State of M.P. and others.

You seem to be ill advised. More so if at all any false affidavit was filed then you had the option of moving under Contempt of Courts Act and in such matters Section 2(c) is there and recourse could be taken to the same by making an application before Advocate General of the State concerned in the matter of criminal contempt.

I am sorry to point out that persons like you defame the judiciary without knowing law and making unwarranted remarks and statements.

With regards,

Sincerely yours,

Deepak Chandna)
