my name is sudhir.I have purchaced shop in joint name with my grandfather(KISAN)in 2008.Grandfather died in 2010.my father died in 2006.whereas the full amount for shop purchased has been given from my mummys account.Grandfather does not have any money but my mom look after him.Now I want to sell the shop.grandfather has one son and one daughter who live in england.she never come in india.How I can sell it with clear title??

Dear Sudhir,

With the demise of your grandfather, since the shop is in joint names and you wish to sell it, the buyer may insist on the NOC from your grandfather's son and daughter, which you may have to organize accordingly to complete the sale deed.

for sals of shop, you can procure POA from the legal heirs of grandfather, or else you have to file the civil suit for declaration
