Legal Question in Credit and Debt Law in India

Cheque Bounce on stop payment request

I had enrolled into educational institution for a program, wherein they had committed on certain services, which they failed to provide. For this I have filed a suit of malpractice under Consumer Protection Act against them and asked them for a refund of the entire fees as I am disillisuioned with the institution . Further, in accordance to their prospectus which had an inbuilt EMI facility for the education, I had availed of the same. However, once the dispute arose, I had put a stop payment on all the cheques issued to them till the dispute is settled and intimated them on the same. However they chose to ignore my request and had initiated the cheques for payment, which have bounced.

Please update as to what legal action can they take against me on the above and what recourse should I adopt to case.

Re: Cheque Bounce on stop payment request

First of all ,you will have to assure yourself as to there was sufficient balance in your account to honour the first cheque. Moreover, since you stopped the clearance of cheque under intimation to the institute on the grounds of dispute, the institute prima facie can not initiate any legal action against you.
