Cheque Bouncing

I have a cousin brother in Bhopal to which i have given 1.5 lac loan for personal business through a cheque from by bank account in bhopal. He was suppose to return me the money in two years along with some assured profits. But he failed to return the money. 3 days before i have got the cheque return which i have taken from him as security when i gave him that loan. he has stopped the payment of the cheque and now he has sent a notice through LAWYER that he has not taken any loan and the cheque is not issued by him. all attempts to persuade him has already failed at all levels. he insist that he will get more time to settle money if i file a 138 act case in court. because cases takes months to settle.

You may file a case in Small Cause Courts as for the intial movement in this case.
