Legal Question in Criminal Law in India

Cheque Bounce Case

Hi Sir,

One person had taken our land papers and few documents from my house. Later we got to know that she had presented the cheque in Bank and claimed for 4 Lacs which is bounced.

We had filed a case in Police station for documents lose and signature was forged and it can be easily identified as fault. (She claims the amount saying house documents are supporting to the cheque)

Please let me know, whether we can argue towards fault signature.

Thanks and regards

Re: Cheque Bounce Case

EACH AND EVERY OFFENSIVE ACT OF A PERSON CALLS FOR A DISTINCT FIR. YOU CAN GET LODGED ANOTHER FIR AND CHEATING DONE UPON YOU. AS YOU HAVE TOLD THAT YOU HAVE LODGED A COMPLAINT TO THE POLICE, BUT YOU HAVE NOT REVEALED WHETHER THE COMPLAINT HAS BEEN ACTED UPON. IF NOT, YOU CAN APPROACH THE COURT AND RELYING UPON CERTAIN JUDGMENTS OF SUPREME COURT, CAN SEEK DIRECTIONS FOR THE REGISTRATION OF THE FIR FROM THE COURT TO THE STATION HOUSE OFFICER.

Re: Cheque Bounce Case

Ofcourse one can claim the cheque to be forged but the case sounds to be unrealistic so you will have a hard time proving it.A lot will depend upon the circumstance of the case like how the person had access to your house etc..Thank You,Sheena.

Re: Cheque Bounce Case

dear sir,

firstly get registered FIR for theft of property papers and also FIR for fraud and forgery against culprits/lady and also file complaint in court against the lady.you are also advised to file a suit for declaration against the lady and can claim your property and get the declaration that no transaction had ever been taken in respect of property.

in case of any other query/assistance cal on 9873343288(delhi).

thanks.

siddharth
