Trial of 498a

What is the time frame limit after a trial starts to finish,how many times are summons issued to the witnesses they r not turning up is it better to get the case dismissed or make them present and get acquittal.

Pls reply, as i want to file counter cases against them.

Counter case need not wait till disposal of this case.

Court has to follow procedure laid down. In case you are in jail or a senior citizen, you can obtain orders of expedited hearing and disposal of case.

no time frame,but speedy trial is the mandate of law.you can draw the attention of court,court can compelled to attend.

Non-appearance can not be ground for dismissal of case.There are ways to force the witnesses to appear in case.The summons are issued by court unless and untill the same are not served. so make the witnesses present and get acquitted.

If you can convince the court that the witnesses or opposite party are deliberately avoiding the trial with the intention of delaying the same the court will compelled their presence by other means.
