Cheater husband

I got married on 15th sep. 2005 by hindu rites and after 15 days my husband left me to my parents house & come to my home regularly. But he never take me to his own home whenever I forced him he told me that he is so busy & used to travel a lot so its not possible for him to take to his home. After one year when I go to his house I come to know that he is a muslim person he cheats me. He is already married & has a daughter too. He took 2 lakhs rs. from my parents & am still in my parents home. I our marrige is legal? Plz suggest me wht I have to do

First of All

First of all just narrate all the facts right from the begining on a piece of paper. Read it and confirm what you have written.

Just go to the police and lodge a complaint against that person. Also mention the fact that he has taken 2 lakhs from you.

Police will take necessary action against him. He has commited an offence for which he has to be punished severely.

The marriage is nullity. The Hindu Marriage act applies only to Hindus, hence your husband who is muslim and has suppressed this facts from you, has committed an offence of cheating. You may complain to the police for taking the criminal action. As regards your marriage, it is advisable to file case for nullity of marriage under the provisions of Indian Divorce Act as the former wife was living at the time of your marriage and was in force. your marriage is illegal. only action you can take aginst him is to prosecute him for cheating under section 420 IPC for which lodge a complaint with the police. The amount of Rs. 2 lakhs can be recovered from him in case you are in a position to prove the same. For recovery of the amount you or your parents will have to file a suit for recovery of the said amount, upon which court fee shall be payable.

It is a case of cheating and you have an option to file a case of cheating and rape also as the marriage was illegal from its inception but your so said husband lured you and make you believe that you are his legally weded wife and had made sexual intercourse with your consent under said misconception which is a form of rape.In order to recover Rs. 2 lacs you and your parents have to file recovery suit.

so sorry for you and if you can then file criminal cases as well as civil cases for cheating and damages respectively.

your marriage is illegal and ur life has been ruined..... for the time being....... so dont leave him scot free.

Your husband had procured your consent for co-habitation by fraud; therefore, he is guilty of rape. You should report the matter to the police immediately.
