Legal Question in Family Law in India

dear sir,

my sister got married 2yrs before now she is having 1 son who lives with us as they were not able to take care of him since first day as both husband & wife were working,now after some family scandal husband decided to leave his home & they started living on rent somewherelse we again helped to arrange all the things at home but after few days his family gave an article in news paper that they dont have any relation to his son & they will not be responsible for anything, meanwhile in just 2 or 3 days her husband told him that he got a transfer at work so he has to go to another city & join his job there,now situation is this she is living with us since last few months.

when they started living seperately we asked from boys parents that they r living seperate so give money to them which we gave in wedding for all their comfort like tv,fridge etc. car also or otherwise how they will be living without anything after all we paid this for girl & now she is without anything ,they refused to pay even a single rs. not even her gold. what to do we tried even to make settlement with the help of some respected citizens of city but no result. we should file the case against them or what if u can suggest something as girl is living at our home & her husband even dont come to see her or his son too.

You should contact a good lawyer at the district court in your city and proceed to file a complaint in the Womens Cell against the boy and his family.

I agree. If your efforts for concilliation have failed, you may consider filing a complaint under Sections 406/498-A of IPC. You may also seek your remedies under the Domestic Violence Act.
