Legal Question in Family Law in India

Hello,

I am seperated from my wife since the last 5 years.I applied for a divorce in 2010. The court has sent notices to her address several times.But each time, the notice is returned stating that the Respondent does not reside at the address.Now I have come to know that my wife has shifted to another country.She has aslo taken my kid without informing me.

The lawyer appointed by her family sometimes attends the hearing.But they have not filed any vakalatnama.Hence the court refuses to grant ex parte or permission to take a paper publication.

Please let me know what are the options available to me.

You can serve at the foreign country, where your wife is presently residing. Your lawyer can make an application for substituted service, normally court will not decline this.
